Can a Woman Traveling Without a Maḥram Shorten Her Prayers?

Question:

AsalamualaikumIs it true that Muslimah who travel without a mahram or don’t wear hijab cannot combine and shorten the pray?

Answer:

All perfect praise be to Allah, the Lord of the worlds. I testify that there is none worthy of worship except Allah and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

The majority of scholars—apart from the Ḥanafīs—hold that whoever undertakes a journey that is itself unlawful is not entitled to avail himself of the concessions granted to travelers, such as shortening and combining the prayers or breaking the fast in Ramaḍān. This is so that the Sharīʿah does not facilitate or assist in the commission of sin. Since a woman's travel without a maḥram is unlawful, she is not entitled to the concessions of travel while undertaking such a journey.

As for a woman who travels while displaying immodest adornment (tabarruj), she is still entitled to the concessions of travel. Her case is not the same as that of a woman traveling without a maḥram, because if the woman guilty of tabarruj covers herself properly, her sin ceases while the permissibility of her journey remains unchanged. Thus, her sin does not prevent her from benefiting from the travel concessions. In contrast, the unlawfulness of a woman traveling without a maḥram does not cease except by abandoning the journey itself.

Accordingly, there is a distinction between a journey that is unlawful in itself and committing a sin during an otherwise lawful journey.

If the journey itself is unlawful, the concessions of travel do not apply. However, if the journey is lawful, the traveler may avail himself of the travel concessions even if he commits a sin during the course of that journey.
